GanttHQ (formerly Marga; the "Service") is operated by Andrew Schaefer, an individual based in Maryland, USA ("we", "us"). These Terms, including the cancellation and refund terms in section 6, are a contract between you and us. By creating an account or using the Service you agree to them. Our Privacy Policy, below, explains how we handle your information. If you don't agree, don't use the Service.
New accounts get a free trial. Its length is shown in the app, and no payment details are needed to start it. One trial per person; we may end trials created to get around this. When the trial ends, continued access requires a paid subscription.
After your trial, without an active subscription, your schedules are locked: you can't open, edit or share them until you subscribe. Your account page, sign-out and account deletion stay available, and subscribing restores access. We may delete the schedules of an account that has been locked for more than 12 months, but only after emailing you at least 30 days beforehand.
Don't:
GanttHQ calculates dates, float and critical paths from what you enter. Results depend on your inputs, and software can be wrong. Review them before relying on them for commitments, contracts, safety or financial decisions. How you use the results is your responsibility.
We may change, add or remove features. If we stop offering the Service altogether, we'll give at least 30 days' notice by email, let you export your schedules, and refund the unused part of any prepaid subscription.
You can stop using the Service and delete your account at any time. We may suspend or close accounts that seriously or repeatedly break these Terms, where the law requires it, or where an account puts the Service or other users at risk. Where reasonable, we'll tell you first and let you export your data. Sections 7, 9 and 12–15 continue to apply after this agreement ends.
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the Service will be uninterrupted or error-free, or that data will never be lost.
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising out of or related to the Service. Our total liability for all claims related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or $50.
Some places don't allow these exclusions or limits, so some may not apply to you. Nothing in these Terms limits liability that can't be limited by law.
If a third party makes a claim against us because of Your Content or your breach of these Terms, you'll cover our reasonable losses and costs from that claim, to the extent the law allows.
These Terms are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-law rules. Please email us first; most problems can be resolved quickly. Any dispute that can't be resolved will be decided in the state or federal courts located in Maryland, and you and we agree to their jurisdiction. Either of us may bring a qualifying claim in small-claims court instead. If you're a consumer outside the US, you keep any protections your local law gives you that can't be waived.
We may update these Terms. For material changes, we'll email you or show a notice in the app before they take effect. If you keep using the Service after that, the new Terms apply; if you don't agree, you can cancel and delete your account.
These Terms and the Privacy Policy are the whole agreement between us about the Service. If a part is unenforceable, the rest still applies. Not enforcing a part isn't a waiver of it. You can't transfer this agreement without our consent. We may transfer it to someone who takes over the Service, and we'll tell you if we do.

We don't use advertising or tracking cookies, and nothing follows you to other sites.
We don't sell or rent your personal information or share it for advertising. We share it only with:
You can view and correct your name and email, export your schedules and delete your account in the app. You can also email us to ask for a copy of your information, a correction or deletion, and we'll respond within the time the law requires. We won't treat you differently for asking.
US state privacy laws (such as California's): we don't sell or share personal information for targeted advertising, and we don't use sensitive information to infer characteristics about you. You can exercise the rights above through the contact address.
EU, UK and Switzerland: we process your information to perform our contract with you (running your account and subscription), for our legitimate interests (security, fixing problems), and to meet legal obligations (such as tax records). You can access, correct, delete, export or restrict your data, object to processing, and complain to your local data-protection authority. Your data is processed in the United States and other countries where our providers operate, under the safeguards those providers offer (such as standard contractual clauses).
Connections are encrypted. Passwords are hashed. The database allows each account to reach only its own schedules and ones shared with it. No system is perfectly secure; if a breach affects your information, we'll notify you as the law requires.
GanttHQ isn't for anyone under 18, and we don't knowingly collect information from children under 13. If you believe a child has given us information, email us and we'll delete it.
We'll update the date at the top when this policy changes, and email you before material changes take effect.
